Protecting Your Creative Works: An Entertainment Lawyer's Guide to Copyright Law in Texas

In Texas, the copyright law is codified in the Texas Business and Commerce Code. Section 641.052 of the code provides important protections for those who have registered their copyrighted works with the U.S. Copyright Office.


Under Section 641.052, if a copyright holder registers their work with the U.S. Copyright Office, they have a right to file a lawsuit in Texas state court for infringement of that work. This means that a copyright holder can bring a lawsuit in state court, rather than federal court, to enforce their copyright.


This is a significant advantage for copyright holders, as state courts can often be a more favorable venue for copyright litigation than federal courts. Additionally, state courts can often provide quicker resolution of copyright disputes, which can be particularly important in the fast-paced entertainment industry.


It is important to note, however, that copyright registration with the U.S. Copyright Office is not required for a work to be protected by copyright. Even if a work has not been registered, it is still protected by copyright as soon as it is created. However, registering a copyright provides additional benefits, such as the ability to sue for infringement in state court.
